What are Cookies
Cookies are small text strings that a website can send, during navigation, to the user’s device (be it a PC, a notebook, a smartphone, a tablet; they are usually stored directly on the browser used for navigation). Main categories of Cookies
The regulation (Article 1 of the provision) identifies two macro-categories of cookies: Technical and Profiling.
Technical Cookies
Technical cookies are those used for the sole purpose of ‘carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide such service’ (see Art. 122, para. 1 of the Code).
They are not used for any other purpose and are normally installed directly by the owner or operator of the website. They can be divided into navigation or session cookies, which ensure normal navigation and use of the website (allowing, for example, to make a purchase or authenticate to access restricted areas); analytics cookies, assimilated to technical cookies where they are used directly by the website operator to collect information, in aggregate form, on the number of users and how they visit the site functionality cookies, which allow the user to navigate according to a set of selected criteria (e.g. language, products selected for purchase) in order to improve the service rendered to the same.
Users’ prior consent is not required for the installation of such cookies, while the obligation to provide information pursuant to Article 13 of the Code remains in place, which the site operator, if it only uses such devices, may provide in the manner it deems most appropriate.
Profiling cookies
Profiling cookies are designed to create profiles of the user and are used to send advertising messages in line with the preferences expressed by the user while surfing the web. Due to the particular invasiveness that such devices may have in the private sphere of users, European and Italian legislation provides that the user must be adequately informed about their use and thus express his valid consent.
They are referred to in Article 122 of the Code where it provides that ‘the storage of information in the terminal equipment of a contracting party or user or access to information already stored is permitted only on condition that the contracting party or user has expressed consent after having been informed in the simplified manner set out in Article 13(3)’ (Article 122(1) of the Code).
Within these categories, it is then appropriate to specify the difference between
– first-part cookies, which are cookies generated and managed directly by the operator of the website on which the user is browsing (the website you are visiting)
– third-part cookies, which are generated and managed by parties other than the operator of the website on which you are browsing (e.g. third-party services that are ‘included’ in the website you are visiting: AdSense, YouTube, Google+, Maps, social sharing buttons, etc.)
and finally the differences between
– session cookies, which are deleted immediately when you close your browser
– persistent cookies, which remain in the browser for a certain period of time. They are used, for example, to recognise the device connecting to the site, facilitating authentication operations for the user.
Management of cookies by the user
It is also possible to remove existing cookies and block the installation of new cookies via the browser settings. If users/visitors wish to decide on a case-by-case basis whether or not to accept cookies, they can also configure their browser to generate a warning each time a cookie is saved. Of course, by refusing the use of cookies (especially technical cookies), some sections of the sites you visit may not function properly, or not function at all.
The user can also manage cookies with the help of free external services, such as www.youronlinechoices.com, through which a selective opt-out for the main cookies used on the web is possible, or through the Do Not Track option provided by the main browsers.
The browsers also provide for the possibility of blocking third-party cookies only, accepting only the site’s own cookies. The procedure for managing cookies is different for each browser. Below are instructions for the most common browsers:
